Probate & Estates

What is Probate of a Will: following a person’s death, a Grant of Probate is normally required to enable any property of the deceased person to be dealt with, which requires an application to the Probate section of the High Court of Northern Ireland. A good Probate Estate definition as defined by GOV.UK is “applying for the legal right to deal with someone’s property, money and possessions (their ‘estate’) when they die”.

Taking the weight of your shoulders

James McNulty & Co Solicitors have assisted families who have lost loved ones for the last 85 years. We take care of the legal formalities at this difficult time including contacting HM Revenue & Customs, the DHSS and Pensions Branch, banks, building societies, insurance companies and government departments on the relatives’ behalf. We deal with reading the Will, explaining the wishes of the deceased, inheritance tax issues, payments of funeral expenses, burial disputes, inheritance disputes, legacy payments and transfer and distribution of assets following death.

In short, we take care of all the legal and administrative work following the death of a loved one, including probate a will and probate real estate or avoiding probate, so the family and friends of the deceased can mourn their loved one as well as celebrate their life, free from worry and stress.

You can rely on our probate solicitors, Deirdre McSorley, Shauna Allison and Eileen Hackett to take care of the following:

  • preparation and submitting of the Inheritance Tax Return
  • obtaining professional valuations of all the assets owned by the deceased
  • preparing the application for a Grant of Probate
  • arranging payments of any debts, liabilities and legacies of the deceased
  • administering any trusts set up under the deceased’s will
  • obtaining tax clearance from HMRC
  • preparing a distribution account of all monies held in the estate

McNulty Co Bereavement

When my mother passed I used James McNulty & Co to administer her estate as I was familiar with the firm from my own dealings with them.  Shauna Allison’s approach and knowledge were excellent, calls were returned promptly and explanations of the law were detailed but in plain English. I would strongly recommend the firm for their overall approach.

Deirdre McSorley dealt with my late aunt’s estate for us.  Deirdre’s knowledge of old shares that went back years was impressive and was able to get payment for us when we though none would be made.  Thank you for your great diligence in looking after us Deidre.

James McNulty were my parents solicitors for years and they dealt with both of my parents estates who died within a short time of each other.  We were impressed by how they dealt with matters and moved our business to them.  Their offices are pleasant and open which is how they go about their work.

Eileen Hackett dealt with our father’s estate after he passed on.  Eileen obtained the valuations promptly and moved the paperwork on at a good pace as we were being pressurised by the department.  We would use Eileen again and recommend her to others.
